§ 863 Seaman'S Right To Refuse

Key Takeaways

  • •Workers on a ship don't have to sail if the ship isn't safe.
  • •If they think the ship might not be safe, they can refuse to work until it's checked by an expert.
  • •The law protects them from being forced to work on an unsafe ship.

Example

A fisherman is told to go out on a boat that looks rusty and has a broken radio.

The fisherman can say no and ask for the boat to be checked first. If the boat isn't safe, he doesn't have to go.
