§ 7072 District Personnel Appointment Authority

This law lets the district's board or its appointed administrator hire people, set their pay, and decide their duties, and those workers can be removed at any time.

Key Takeaways

  • •The board can appoint and set pay for district officers, employees, attorneys, engineers, and consultants.
  • •If the board appoints an administrative officer, that officer can do the hiring and pay decisions for most employees, but not for attorneys, auditors, or consultants.
  • •All appointed employees serve at the pleasure of the board or the administrative officer and can be removed whenever they choose.

Example

A city's water district is run by a board that appoints a manager to handle daily operations.

The manager can decide to hire a clerk, set the clerk's salary, and tell the clerk what tasks to do. If the manager later decides the clerk isn't needed, he can let the clerk go without any special reason.
