§ 669 Regulation Adoption Procedures

This law says any rules the department makes have to follow the step‑by‑step process laid out in Chapter 3.5 of the Government Code.

Key Takeaways

  • •Department rules must be created using the process in Chapter 3.5 of the Government Code.
  • •The process includes things like public notice and comment before a rule can take effect.
  • •If the department skips those steps, the rule could be thrown out.

Example

The state health department wants to add a new rule about how often restaurants must be inspected.

Before the rule can become official, the department must use the procedure in Chapter 3.5—like giving notice, letting the public comment, and following any other steps the chapter requires.
