§ 6296 District Eminent Domain Authority

• •The district has the power to take private property.
• •It can only do this when the property is needed for the district’s projects or goals.
• •The taking must follow the district’s right of eminent domain.

The school district wants to build a new playground but a family’s backyard is in the way.

Because the law says the district can use eminent domain to take any property needed for its purposes, the district can legally acquire that backyard to build the playground.
