§ 6045 District Formation Challenge Deadline

This law says you only have 60 days to challenge the creation of a new district after the state files the paperwork. If you wait longer, you can't sue to stop it.

Key Takeaways

  • •You only have 60 days to sue if you think a new district was created wrongly.
  • •After 60 days, no court will listen to your complaint.
  • •The 60 days start when the state files the official papers with the local government.

Example

A new school district is created in your town, but some parents think it was done unfairly.

If the parents want to sue to stop the new district, they must do it within 60 days after the state files the official papers. If they wait even one more day, the court won’t hear their case.
