§ 5874 District Formation Challenge Deadline

This law says you only have 60 days, and must use the right court, to challenge how a district was created or the money it borrowed.

Key Takeaways

  • •You must start any lawsuit about a district’s creation or its debt within 60 days of the filing date.
  • •The lawsuit has to be filed in a court that has the power to hear it.
  • •If you miss the 60‑day deadline, you can’t later try to overturn the district or its borrowing.

Example

A new fire district is set up and takes out a loan. A homeowner thinks the district was formed wrong and wants to sue, but waits two months before filing.

Because the homeowner waited more than 60 days, the court will not let the case go forward, even if the claim is true.
