§ 1154 Board Administrative Powers

This law lets the board run the whole division and make any rules it needs, except for the parts that belong to the Secretary of Business, Transportation and Housing.

Key Takeaways

  • •The board handles all day‑to‑day duties for the division, unless a duty is specifically given to the Secretary.
  • •The board can create and enforce rules it needs to do its job.
  • •When making rules, the board must follow the rule‑making process set out in Chapter 3.5 of the Government Code.

Example

A city’s housing board wants to set new safety standards for apartment inspections.

Because the law gives the board the power to make and enforce rules for the division, the board can write those safety standards, as long as it follows the proper rule‑making steps. The Secretary of Business, Transportation and Housing would handle any duties that the law says belong to that office, not the board.
