§ 9906 Invalid Provision Severability

Key Takeaways

  • •If one part of the law is found to be invalid or unenforceable, the rest of the law can still be used.
  • •The law is designed so that if one piece doesn't work, it doesn't break the whole thing.
  • •This rule helps keep the law useful even if a small part has problems.

Example

Imagine a law that says you can't park in certain spots and also can't speed in a school zone.

If a judge says the part about parking is unfair, the rule about not speeding near schools can still be enforced. The law doesn't just disappear because one part didn't work.
