§ 8188 Judgment Validity And Appeals

Key Takeaways

  • •This law is about how a court decides if something is valid or not, based on what’s in Section 8187.
  • •If you don’t like the court’s decision, you can ask for a new trial or appeal, but you only have 90 days to do it.
  • •You can also ask the court to reopen the case under special rules (Sections 473 or 473.5) if there’s a good reason, like a mistake or new evidence.

Example

Imagine you and your neighbor argue over who owns a piece of land. The court makes a decision saying it’s yours.

If your neighbor thinks the court made a mistake, they have 90 days to ask for a new trial or appeal. If they miss that deadline, they can’t challenge it anymore unless they have a really good reason (like the court made a big mistake).
