§ 75064 Election Defeat Disability Presumption

Key Takeaways

  • •If a person loses an election and applies for disability retirement, it's assumed they are not actually disabled.
  • •They must prove their disability with very strong evidence to get retirement benefits.
  • •They need written statements from at least two doctors or psychiatrists to support their claim.

Example

A mayor loses their re-election and then applies for disability retirement, saying they can't work due to stress.

The law assumes the mayor is not really disabled just because they lost the election. They must prove their disability with strong evidence, like statements from two doctors, to get retirement benefits.
