§ 75062 Judicial Disability Retirement Presumption

Key Takeaways

  • •If a judge is charged with or convicted of a serious crime (like a felony) and applies for disability retirement, they are assumed to not be disabled.
  • •The judge must prove with very strong evidence that they are actually disabled.
  • •The judge needs at least two doctors or psychiatrists to write statements supporting their disability claim.

Example

A judge gets into big trouble for taking bribes (a felony) and then tries to retire early because they say they are too sick to work.

The law says this judge is automatically assumed to not be sick enough to retire. They have to prove with really strong evidence—like statements from two doctors—that they are actually disabled. If they can’t prove it, they won’t get the disability retirement.

(b) Shall, in a disability retirement proceeding before the commission, be subject to the standard of proof of clear and convincing evidence sufficient to sustain a claim to a reasonable certainty. (c) Shall support the application with written statements described in subdivision (c) of Section 75060 from each of at least two physicians or two psychiatrists. (Added by Stats. 1988, Ch. 993, Sec. 5.)
