§ 72302 Felony Arrest Bail Acceptance

Key Takeaways

  • •If someone is arrested for a serious crime (felony) because a judge signed a paper (warrant) saying so,
  • •The court worker (clerk) can take money (bail) from the arrested person to let them go free until their court date.
  • •The amount of money (bail) is already decided and written on the judge's paper (warrant).
  • •This rule was updated in 1998 to make sure it's clear how bail works in these cases.

Example

John is arrested because a judge signed a paper saying he might have stolen a car.

The court worker can take the bail money (let's say $50,000) from John or his family, and then John can go home until his trial. The amount ($50,000) was already written on the judge's paper.
