§ 66606 Property Rights Protection

Key Takeaways

  • •The government can't take or harm your private property for public use without paying you fairly for it.
  • •This law doesn't change any property owner's rights under the California or U.S. Constitution.
  • •If the government wants to use your land for something public (like a road), they have to pay you what it's worth.

Example

The government wants to build a new highway and needs to use part of your backyard.

They can't just take your land—they have to pay you a fair price for the part they use. This law makes sure you get paid if the government takes or damages your property for public projects.
