§ 65912 Open-Space Zoning Compensation

Key Takeaways

  • •The government can't use zoning laws to take or harm private property without paying the owner fairly.
  • •This law doesn't change any property owner's rights under the state or U.S. Constitution.
  • •If the government wants to use your land for public stuff (like parks), they have to pay you for it.

Example

Imagine you own a big piece of land, and the city wants to turn part of it into a public park.

The city can't just take your land or make rules that hurt its value without paying you what it's worth. They have to give you fair money for it.
