§ 51059 Open-Space Easement Recording

Key Takeaways

  • •When a piece of land is protected as open space (like a park or farmland), the government writes it down officially.
  • •The government must record this protection in two places: the county recorder’s office and the county assessor’s office.
  • •Once it’s recorded, everyone knows about it—just like when you record who owns a house.
  • •This rule makes sure no one can pretend they didn’t know the land was protected.

Example

A town wants to protect a big field so no one can build houses on it. They make a rule saying it’s now ‘open space’ forever.

The town writes this rule down and gives a copy to the county recorder and the county assessor. Now, if someone tries to buy the field later, they’ll know they can’t build on it because it’s recorded.
