§ 38510 Park Land Abandonment Rights

Key Takeaways

  • •If a park is sold or abandoned, private people or companies keep their rights to use parts of that land (like paths or pipes).
  • •Other government agencies also keep their rights to use the land for things like roads or schools, not just parks.
  • •If the park land is sold, it doesn’t automatically go back to the person who owned it before, unless the original deal said it would.

Example

A city decides to sell an old park because not many people use it anymore.

Even if the park is sold, a company that has pipes underground for water can still use them. Also, if there’s a road through the park, the city can still use that road. The land doesn’t just go back to the person who owned it before it was a park unless the old papers said it would.
