§ 25588 Park Land Ownership Rights

Key Takeaways

  • •If a county stops using a park or sells it, private owners keep their rights to any land they own inside the park.
  • •Other government agencies (like water or road departments) also keep their rights to use parts of the park for things like pipes or roads.
  • •If the park land is given up by the county, it doesn’t automatically go back to private owners unless the original deal says it can.

Example

A county decides to sell an old park to build a school.

If someone owns a small piece of land inside that park (like a house or a store), they still own it even after the park is sold. Also, if there’s a water pipe running through the park owned by the city, the city keeps the right to use that pipe. The land doesn’t just go back to the old owners unless the original park deal said it would.
