§ 31952 Board Member Term Protection

Key Takeaways

  • •If someone is already on the board, new rules don’t kick them out early.
  • •They stay on the board until their original term ends, even if new rules say they wouldn’t qualify now.
  • •This rule keeps things fair for people already serving.

Example

Imagine a school board member was elected for 4 years. After 2 years, a new law says board members must live in the town, but this member just moved away.

The member gets to stay on the board for the remaining 2 years because they were elected under the old rules.

§ 31952 Board Member Term Protection

Neither the enactment of this chapter nor any amendment of its predecessor shortens the term of any member of the board who was lawfully elected or appointed, even if he would not be eligible for election or appointment under this chapter or such amendment, but he shall continue to be a member of the board until the expiration of the term for which he was appointed or elected. (Added by Stats. 1947, Ch. 424.)
