§ 23264 County Boundary Change Report

Key Takeaways

  • •A group of five people (the commission) has 180 days to make a decision and write a report about changing county borders.
  • •Once the commission makes a decision, it’s final and both counties must follow it if the border change happens.
  • •The leaders of both counties (board of supervisors) have 30 days to say yes or no to the border change after they get the report.

Example

Imagine two towns want to change their border because one town needs more land for new houses.

The commission studies the issue and writes a report saying how the border should change. Both towns have to follow the new border if they agree to it. If one town doesn’t like the change, they have 30 days to say no.

The determinations of the commission shall become the terms and conditions for boundary change and as such shall be final and binding on both affected counties should the proposed boundary change be legally effected as provided in this article. At any time not later than 30 days after receipt of the commission’s report, if the territory proposed to be transferred is inhabited or if it is uninhabited and there is no majority protest, the board of supervisors of both affected counties shall adopt a resolution approving or disapproving the proposed boundary change.
