§ 22203 State-Federal Agreement Requirements

Key Takeaways

  • •Before the state can make a deal with the federal government, it must first make a written deal with the local group involved.
  • •The deal must include rules that the state thinks are needed to manage the federal system for the local group and its workers.
  • •The state itself is not considered a local group in this case, but certain big groups (like the Teachers’ Retirement Board or the University of California) are treated like local groups for this deal.

Example

A city wants to join a federal program to help its firefighters get better benefits.

Before the state can sign a deal with the federal government, it must first write down an agreement with the city. This agreement will include rules about how the federal program will work for the city and its firefighters. Even though the state isn’t considered a local group here, the city is, so the state and the city must agree on these rules first.

For the purposes of this section, the state shall not be deemed to be a public agency, but nevertheless an agreement entered into pursuant to this part by the board and the Teachers’ Retirement Board or the Adjutant General or the Regents of the University of California or the governing body of a public agency, as defined in Section 22009.03, shall be deemed to be entered into by the board and a public agency.
