§ 21233 Disability Retiree Reemployment Restrictions

Key Takeaways

  • •If you retired because you got hurt or sick at work, you can't go back to the same job or a job with the same tasks that you couldn't do before.
  • •If your boss wants to hire you again after you retired for being hurt or sick, they have to tell the board what job you'll do and what tasks it includes.
  • •This rule doesn't apply if you're hired under a different special rule (Section 21232).

Example

A firefighter retires because they hurt their back and can't carry heavy things anymore.

This firefighter can't go back to being a firefighter or take another job that requires carrying heavy things unless they follow the rules and get approval. If the fire department wants to hire them again, they have to tell the board what the new job is and what tasks it includes.
