§ 20099 Board Committee Delegation Authority

Key Takeaways

  • •The board can pick a small group of its members or the boss to do jobs the board is allowed to do.
  • •If the board doesn't say the group or boss can make the final decision, they have to tell the board what they did at the next meeting. The board can then say 'good job' or 'no, change it'.
  • •If the board says 'no' to what the group or boss did, it’s like it never happened, but any money already paid out stays paid unless the board says to get it back.
  • •The boss can give their own jobs to their workers unless the board says the boss has to do it themselves.

Example

The school board lets the principal decide to buy new playground equipment.

The principal picks the equipment and buys it, but at the next board meeting, they have to tell the board what they did. If the board doesn’t like the choice, they can say 'no' and maybe pick something else. But if the equipment was already paid for, the money isn’t automatically taken back unless the board says so.

§ 20099 Board Committee Delegation Authority

The board may appoint a committee of one or more of its members to perform any act within the power of the board itself to perform. The board may also delegate authority to the executive officer to perform those acts. Except where the board, in delegating authority to a committee or the executive officer, provides that the committee or the executive officer may act finally, all acts of the committee or the executive officer shall be reported to the board, at its next regular meeting, and shall be subject to review and ratification or reversal by the board. Reversal by the board of any act of the committee or the executive officer shall be effective as of the date fixed by the board, but payment of benefits prior to board action shall not be affected by that action, except for such recovery of amounts paid from the person to whom they were paid as the board may direct. The executive officer may delegate to his or her subordinates any act or duty unless the board by motion or resolution recorded in the minutes has required him or her to act personally. (Added by Stats. 1995, Ch. 379, Sec. 2. Effective January 1, 1996.)
