§ 19574 Adverse Action Notice Requirements

Key Takeaways

  • •Your boss can punish you at work, but they have to tell you in writing first.
  • •The warning must say what they’re doing, why, and when it starts.
  • •You get a chance to explain your side before they punish you.
  • •This rule only applies to certain state workers (State Bargaining Unit 5).

Example

Your boss wants to suspend you for being late too many times.

They must give you a written warning first, saying you’re suspended, why (like ‘you were late 10 times’), and when it starts. They also have to tell you that you can explain why you were late. If they don’t do this, the suspension isn’t fair.
