§ 16606 Officer Bond Liability Exemption

Key Takeaways

  • •If a state officer puts an inmate's money in a savings and loan or credit union, and that place fails, the officer isn't responsible for the lost money.
  • •The officer must have followed the law and acted in good faith when depositing the money.
  • •This rule only applies if the officer was supposed to handle the inmate's money as part of their job.

Example

A prison officer puts money from inmates into a local credit union, as required by law. Later, the credit union goes out of business, and the inmates' money is lost.

The officer won't have to pay back the lost money if they followed the rules and didn't do anything wrong when depositing it.
