§ 12809 Employee Transfer Protection Rules

Key Takeaways

  • •If you worked at the Human Relations Agency in 1972 and weren't a temp, you might get moved to the Health and Welfare Agency or the Resources Agency.
  • •Your job, pay, and rights stay the same after the move—nothing changes just because you switch agencies.
  • •This only applies if your job was one of the ones moved by other sections of the law (12803, 12806, or 12807).
  • •If your old job wasn’t part of the civil service system, this rule might not cover you.

Example

Imagine you worked at the Human Relations Agency helping people with housing problems. In 1972, the government decided that your job should now be part of the Health and Welfare Agency instead.

Because of this law, you would keep your same job, same pay, and same benefits—just under a new agency. You wouldn’t lose anything or have to reapply just because your job was moved.
