§ 8053 Commissioner Regulatory Authority

Key Takeaways

  • •The person in charge (commissioner) can make, change, or cancel rules to help run savings and loan companies and their groups.
  • •The commissioner can also explain what words mean in these rules, as long as it doesn’t go against the law.
  • •If a rule isn’t needed to protect people, the commissioner can say it’s okay to skip it.

Example

A small savings and loan company wants to try a new way to help people save money, but the current rules say they can’t do it.

The commissioner can decide if the rule is really needed. If not, they can let the company try the new way to help people.

§ 8053 Commissioner Regulatory Authority

The commissioner may from time to time issue, amend and rescind any rules, regulations, forms, and orders that are necessary to carry out the provisions of this division, including rules and regulations governing the administration of any association, savings and loan holding company and their subsidiaries, and defining any terms whether or not used in the law insofar as the definitions are not inconsistent with the provisions of this division. The commissioner may waive any requirement of any rule or regulation in situations where, in the commissioner’s opinion, the requirement is not necessary in the public interest or for the protection of the public.
