§ 1912 Emergency Work Exemption

This law says that if you do emergency work to protect people or property, the normal rules don’t apply, but you have to tell the department about it within 14 days after you start.

Key Takeaways

  • •Emergency work that protects life or property is exempt from the chapter’s normal rules.
  • •The person or agency doing the emergency work must notify the department.
  • •The notice must be sent within 14 days after the work begins.

Example

A city crew rushes to repair a burst water main after a flood to keep homes from flooding.

Because they are fixing something urgent to protect lives and property, they don’t have to follow the usual chapter rules, but they must send a notice to the department within two weeks of starting the repair.
