§ 1616 Pre-2004 Agreement Governance

• •Agreements made before 2004 use the rules that existed before 2004.
• •The rule does not apply to agreements covered by Section 1602(b)(2) that were made before 1977.
• •The rule only affects agreements the department signed, not other types of agreements.

A city department signed a service contract with a nonprofit in 2002. The nonprofit later asks the department to explain the contract terms.

Because the contract was signed before 2004, it is governed by the older rules that applied when it was signed, not by newer rules. The department can refer to the original rules when answering the request.
