§ 1527 Wildlife Land Title Acquisition

This law lets the state take ownership of land for wildlife areas or public shooting grounds, but the state can't pay for it until the title is approved by the Attorney General and officially belongs to the state.

Key Takeaways

  • •The state can acquire land for wildlife or shooting areas even if there are easements or rights‑of‑way, provided they don’t block use.
  • •Payment is only allowed after the Attorney General approves the title and the land is vested in the state.
  • •The rule applies to both wildlife management areas and public shooting grounds.

Example

The state wildlife agency wants to buy a farm to turn it into a wildlife management area.

Even if the farm has old road rights‑of‑way or easements, the state can still acquire it as long as those don't stop the land from being used for wildlife. The agency must wait until the Attorney General says the title is good before it can make any payment.

§ 1527 Wildlife Land Title Acquisition

The department shall do all things necessary to secure a valid title in the State to the property acquired for wildlife management areas or public shooting grounds but no payment shall be made therefor until the title is satisfactory to the Attorney General, and is vested in the State. The acquisition of the property by the State is not prohibited by reason of rights of way, easements, or reservations which, from their nature, in the opinion of the department, will in no manner interfere with the use of the property for the purpose for which it is acquired. (Enacted by Stats. 1957, Ch. 456.)
