§ 10505 State Game Refuge Acquisitions

This law says the state department must get a clear, approved ownership title for land it buys for wildlife refuges before it pays for the land, and existing easements won’t stop the purchase if they don’t mess up the refuge’s use.

Key Takeaways

  • •The department must secure a valid title before any payment is made.
  • •The Attorney General must approve the title before the state takes ownership.
  • •Existing easements or rights of way don’t block the purchase if they don’t interfere with the refuge’s purpose.

Example

The department wants to buy a forest area to turn into a wildlife refuge, but there’s an old road that the public can still use.

The department must first make sure the ownership paperwork is all correct and get the Attorney General’s okay. Only after that can they pay for the land, and the road easement is okay as long as it doesn’t stop the refuge from being used for wildlife.

§ 10505 State Game Refuge Acquisitions

The department shall do all things necessary to secure a valid title in the State to the property acquired for game refuges, but no payment shall be made therefor until the title is satisfactory to the Attorney General and is vested in the State. The acquisition of the property by the State is not prohibited by reason of rights of way, easements, or reservations, which, from their nature, in the opinion of the department, will in no manner interfere with the use of the property for the purpose for which it is acquired. (Enacted by Stats. 1957, Ch. 456.)
