§ 7576 Challenging Parentage Declarations

Key Takeaways

  • •You have up to 2 years to challenge a voluntary declaration of parentage if you signed it because of fraud, pressure, or a big mistake.
  • •If the declaration is already invalid (like if it was signed under false pretenses), the 2-year limit doesn’t apply.
  • •This rule started on January 1, 2020.

Example

A man signs a paper saying he’s the dad of a baby, but later finds out the mom lied about who the real dad is.

He can go to court within 2 years to say the paper is wrong because he was tricked.
