§ 7121 Emancipation Notice Requirements

Key Takeaways

  • •Before a kid can be declared emancipated (legally independent), the court must tell their parents or guardians about it.
  • •If the parents or guardians can't be found, the kid must prove to the court that they tried to find them.
  • •The court also tells the local child support agency about the case.
  • •The notice to parents includes a form to agree to the emancipation and a warning that they might have to support the kid again if the emancipation is canceled.

Example

A 16-year-old wants to be emancipated so they can live on their own and make their own decisions.

The court will send a notice to the teen's parents telling them about the court date. The notice will include a form for the parents to sign if they agree to the emancipation. If the parents can't be found, the teen must show the court they tried to find them. The court will also tell the local child support agency about the case.
