§ 79286 Severability And Construction

Key Takeaways

  • •If one part of this law is found to be unfair or doesn't work, the rest of the law still counts.
  • •The law should be understood in a way that makes sense for most people.
  • •Even if the law doesn't work for one person, it can still work for everyone else.

Example

Imagine a rule at school that says no running in the halls and no chewing gum. If the teacher says the 'no gum' rule is unfair and gets rid of it, you can still get in trouble for running in the halls.

This law works the same way. If one small part is found to be unfair or doesn't work, the rest of the law is still in effect and you have to follow it.
