§ 77708 Statute Severability Clause

Key Takeaways

  • •This law should be understood in a broad and flexible way.
  • •If one part of the law is found to be invalid, the rest of the law can still be enforced.
  • •The law is designed so that if one part doesn't work, it doesn't break the whole law.

Example

Imagine a law that says you can't have loud parties after 10 PM and you must keep your yard clean. If a court says the part about loud parties is unfair, the rule about keeping your yard clean can still be enforced.

This law works the same way. If one part is found to be invalid, the rest of the law can still be used.
