§ 77505 Statute Severability Clause

Key Takeaways

  • •This law should be understood in a broad and flexible way.
  • •If one part of the law is found to be invalid or doesn't work, the rest of the law still applies.
  • •The law is designed so that the valid parts can still be used even if some parts are removed.

Example

Imagine a law that says you can't have loud parties after 10 PM and you can't play loud music in your car.

If a court says the part about loud parties is unfair, the rule about loud music in cars can still be enforced. The rest of the law stays in place.
