§ 6241 District Formation Powers

• •Special districts (like water or fire districts) get all the powers listed in Section 6240 and other laws, no matter what.
• •Even if the papers that created the district say it can’t do something, it can still do it if the law says so.
• •The rules for what the district can do are the same for all districts, no exceptions.

A small town creates a water district, and the original papers say the district can only fix pipes but not build new ones.

Even if the papers say the district can’t build new pipes, the law says it can if Section 6240 allows it. So, the district can build new pipes if the law says so.
