§ 61331 Cooperative Dairy Producer Transactions

Key Takeaways

  • •A nonprofit group that helps farmers sell their milk and dairy products is treated like a farmer in certain situations.
  • •This includes when the group collects, handles, or sells milk and dairy products in bulk.
  • •It also applies when the group gets paid for the milk or dairy products and shares the money with the farmers.
  • •The group must share profits with its members based on how much they contributed.

Example

A group of local dairy farmers forms a cooperative to sell their milk together.

When the cooperative collects milk from the farmers, sells it to a store, and then pays the farmers based on how much milk each one contributed, the cooperative is treated like a farmer in these transactions.
