§ 55648 Lien Preservation After Judgment

Key Takeaways

  • •If someone wins money in court, it doesn’t cancel their right to collect from a lien (a legal claim on property).
  • •Any money collected from the court judgment must be used to pay down the lien first.
  • •The lien stays in place until it’s fully paid, even if the person wins money in court.

Example

A contractor sues a homeowner for not paying for a kitchen remodel and wins $10,000 in court. The contractor also has a lien on the house for the unpaid work.

The $10,000 the contractor wins in court doesn’t cancel the lien on the house. The homeowner still has to pay the lien, but the $10,000 will be used to reduce what’s owed on the lien.
