§ 5462 Lien Foreclosure Deadline

Key Takeaways

  • •If the government cleans up your messy property and you owe them money for it, they can put a legal claim on your property.
  • •If you pay back the money or someone buys your property at a tax sale, the government has 120 days to take legal action to get their money back.
  • •If they don’t act within 120 days, they might lose the chance to get paid back.

Example

Imagine your yard is full of trash, and the city cleans it up for you. They spend $1,000 and say you have to pay them back. They put a claim on your house to make sure they get their money.

If you pay the $1,000 or someone buys your house at a tax sale, the city has 120 days to go to court to make sure they get their $1,000. If they wait too long, they might not get their money back.
