§ 52363 Seed Sample Evidence Rules

Key Takeaways

  • •If a cop takes a sample of something (like seeds) the right way, that sample can be used as proof for the whole batch.
  • •A lab report about the sample is also proof for the whole batch, but not in criminal cases.
  • •This means the person accused has to prove the sample or report is wrong, not the other way around.

Example

A farmer sells a big bag of seeds, and a cop takes a small sample to test.

If the sample is bad, the law says the whole bag is bad unless the farmer proves otherwise. The lab report can be used as proof, but not if the farmer is being charged with a crime.

§ 52363 Seed Sample Evidence Rules

(a) Any sample which is taken by an enforcement officer in accordance with the regulations which are adopted pursuant to this chapter for the taking of official samples is prima facie evidence of the true condition of the entire lot from which the sample was taken. The presumption established by this subdivision is a presumption affecting the burden of proof. (b) A written report which is issued by the State Seed Laboratory that shows the analysis of any such sample is prima facie evidence of the true analysis of the entire lot from which the sample was taken. The presumption established by this subdivision is a presumption affecting the burden of proof, but it does not apply in a criminal action. (Amended by Stats. 1967, Ch. 262.)
