§ 42652 Officer Duty Enforcement Refusal

Key Takeaways

  • •If a police officer refuses to follow orders from their boss, it's considered neglect of duty.
  • •But if the officer doesn't have the money or resources to follow the orders, it's not their fault.

Example

A police chief tells an officer to buy new equipment for their patrol car.

If the officer refuses to buy the equipment without a good reason, they could be in trouble. But if the department doesn't give them the money to buy it, they won't be punished.
