§ 41302 Health Code Enforcement Clarification

Key Takeaways

  • •This law says that just because something is allowed in one part of the rules, it doesn’t mean it’s okay if another part says it’s not.
  • •If another health law says something is illegal, this law won’t make it legal.
  • •The health department still has full power to enforce health rules.

Example

If a law says you can’t sell cigarettes to kids, but another part of the rules seems to allow it, this law makes it clear: selling cigarettes to kids is still illegal.

Even if one rule seems to say it’s okay, the health law that says it’s illegal wins. The health department can still punish people who break the rule.
