§ 38907 Severability Of Provisions

Key Takeaways

  • •If one part of this law is found to be unfair or unenforceable, the rest of the law still stands.
  • •The lawmakers say they would have passed the whole law even if some parts were later found to be unfair or unenforceable.

Example

Imagine a law that says you can't park in certain spots and also can't play loud music in your car. If a judge says the part about loud music is unfair, you can still get a ticket for parking in the wrong spot.

The law still works even if one part is removed. The rest of the rules stay in place.

If any article, section, subdivision, sentence or clause of any provision of this chapter is for any reason adjudged unconstitutional or unenforceable, such decision does not affect the validity of the remaining provisions of this chapter. The Legislature hereby declares that it would have enacted all provisions of this chapter irrespective of the fact that one or more of such provisions is adjudged unconstitutional or unenforceable. (Added by Stats. 1968, Ch. 1250.)
