§ 282 Agricultural Service Fees

Key Takeaways

  • •The director can check and test farm products like fruits, nuts, and trees.
  • •They can charge a fee for these services, but they might not if paying first would make the service less helpful.
  • •The fee should be fair and cover the cost of the work.

Example

A farmer wants the director to test their apples to make sure they are good quality.

The director can charge the farmer a fee to test the apples. But if the director thinks the farmer should pay after the test (so the farmer knows the apples are good first), they can do that instead.

§ 282 Agricultural Service Fees

In cases where the director may perform sampling, grading, testing, inspection, or certification services in relation to any agricultural product, or identification services in relation to root or top stock of any fruit or nut trees, and fix reasonable fees to pay the costs necessary to perform the services he may collect such fees in advance of performing the services. He need not, however, do so if, in his opinion, the benefit of such services would be lessened by advance payment. (Enacted by Stats. 1967, Ch. 15.)
