§ 21705 Animal Shipment Documentation Responsibility

Key Takeaways

  • •The person sending animals (shipper) is responsible for making sure the papers about the animals are correct.
  • •The driver or carrier is not responsible if the papers have wrong info, but they must have the papers with them during the trip.
  • •The driver must give the papers to the person getting the animals so they can show them to the inspector.

Example

A farmer sends cows to a new farm and gives the driver papers saying the cows are healthy.

If the papers are wrong and the cows are actually sick, the farmer (not the driver) is in trouble. But the driver must carry the papers and give them to the new farm owner so they can show them to the inspector.

§ 21705 Animal Shipment Documentation Responsibility

If by any provision of this division a certificate, bill of sale, or other document is required to accompany any shipment of animals, nothing in this division shall be construed to make the carrier, driver, or any person other than the shipper responsible for the accuracy of the information required in the document. The person transporting is, however, responsible for having the documents required by this division in possession during shipment, and the driver shall deliver such document to the person receiving the cattle at destination so it can be presented to the inspector prior to inspection. (Amended by Stats. 1973, Ch. 938.)
