§ 12812 Product Registration Fees

This law lets the director set fees for the pesticide registration program – like yearly fees for each product, late‑payment penalties, and fees to change a product’s registration – and makes sure the money collected each year covers the program’s costs.

Key Takeaways

  • •The director can set yearly fees, late penalties, and amendment fees for pesticide registration.
  • •All money collected must be enough to cover the program’s yearly budget.
  • •Collected fees go into a special fund and can be used only for the pesticide registration program.
  • •If the department might raise fees, it must post the notice online and email it before Jan 31 each year.

Example

A pesticide company files a new product for registration and has to pay the annual registration fee. If they pay late, they also pay a penalty. The money they pay goes into the Department of Pesticide Regulation Fund to keep the registration program running.

The department will charge the company the fee set by the director, add any late‑payment penalty if needed, and use that money to fund the registration program as required by the law.

How to Calculate

Total Revenue = Σ (Annual fee per product + Late‑payment penalties + Amendment fees) = Annual budget amount for the registration program

  1. Find the total amount the department needs for the registration program in the annual Budget Act.
  2. Estimate how many products will be registered (and how many amendments or late payments might occur).
  3. Set the individual fees so that when you add up all the fees, penalties, and amendment fees, the sum equals the needed budget amount.

The department needs $120,000 for the program and expects 60 products to be registered this year with no penalties or amendment fees.

Result: Annual fee per product = $120,000 ÷ 60 = $2,000 each

The fees shall include, but are not limited to, the following: (1) Annual fees for each product submitted for registration. (2) Penalties for the late payment of registration fees. (3) Fees for amendments to registered products. (b) The fees established pursuant to this section may include costs for administration and overhead in connection with administering the fees. Notwithstanding any other law, the regulations shall remain in effect until amended by the director. (f) On or before January 31 of each year, if the department determines that it might increase the fees established pursuant to this section during the calendar year, the department shall post the determination on its internet website and send the determination through any of its relevant, registration-related email lists.
