§ 12783 Pesticide Enforcement Conflict Ban

This law says anyone who is in charge of enforcing this chapter can't be involved in selling, making, or distributing pesticides, even a little bit.

Key Takeaways

  • •Anyone who enforces this chapter must stay completely out of the pesticide business.
  • •The rule covers both direct ownership and indirect interests, like family ties or investments.
  • •Breaking the rule could be seen as a conflict of interest and may lead to penalties.

Example

A state pesticide inspector also owns a small farm supply store that sells pesticides.

Because the inspector is responsible for enforcing pesticide rules, the law says they must not own or profit from a store that sells pesticides. They would have to sell the store or give up the job.
