§ 12400 Pesticide Broker Licensing Requirement

This law says you can't sell or bring into the state any pesticide that the director has approved unless you are the product's registrant, a licensed pest‑control dealer, or have a pesticide broker license.

Key Takeaways

  • •Only the product’s registrant, a licensed pest‑control dealer, or a licensed pesticide broker can sell registered pesticides in the state.
  • •Anyone else who tries to sell, offer to sell, or bring in a registered pesticide is breaking the law.
  • •A broker license must be obtained from the director before selling those pesticides.

Example

A garden store in the state wants to sell a new weed‑killer that the director has registered, but the store owner does not have a broker license.

Because the store owner isn’t the registrant, isn’t a licensed pest‑control dealer, and doesn’t have a broker license, selling that weed‑killer would break the law.
