§ 1532 Public Record Evidence Presumption

Key Takeaways

  • •If a government office keeps a copy of an important paper, that copy is usually enough to prove the real paper exists and what it says.
  • •This only works if the law says that kind of paper should be kept by that office.
  • •If someone questions the copy, they have to show proof that it’s wrong or fake.

Example

You buy a house, and the government office has a copy of the deed (the paper that says you own it).

If someone says you don’t really own the house, the copy at the government office is enough to prove you do, unless they can show strong proof that the copy is wrong.
