§ 1126 Mediation Confidentiality Protection

Key Takeaways

  • •What you say or write during mediation stays private, even after it's over.
  • •No one can use what you said in mediation against you later in court.
  • •Mediation is a safe space to talk openly without worrying about it being shared.

Example

You and your neighbor argue over a fence during mediation. You admit you built part of it on their land by mistake.

Your neighbor can't later use that admission in court to sue you. What you said stays private.
